Section 2115 - [See Note] Forfeiture and default of bail bonds(a) If the defendant fails to appear as required or is found in breach of a material condition of release imposed by any court while under a bond, and the court under this chapter or court rule finds the defendant in default and forfeits the bond, the proceeds must be forwarded to the State Treasurer and deposited in the General Fund.(b) All funds held by the State in any depository derived from forfeiture or default of bonds from any court, except the House Sergeant of the Wilmington City Police, shall immediately be forwarded to the State Treasurer and deposited in the General Fund.(c) The proceeds of any bond forfeited for the defendant's failure to appear in any child support proceeding shall be paid over to the payee of the child support order and applied to the child support account.Amended by Laws 2023, ch. 473,s 13, eff. 6 months after the enactment of a constitutional amendment permitting preventive detention, as proposed by Senate Substitute No. 1 for Senate Bill No. 11 of the 152nd General Assembly..Amended by Laws 2017 , ch. 200, s 1, eff. 1/1/2019.Amended by Laws 2013 , ch. 36, s 1, eff. 6/4/2013.59 Del.
