Section 11-1201 - Definitions

For the purposes of this title:

1. "Hunting" means shooting or killing wildlife, including shooting or killing wildlife lawfully trapped or otherwise reduced to possession, or pursuing or capturing wildlife with any weapon, projectile, or other device or instrumentality; and includes all lesser acts such as disturbing, harrying, or worrying, whether they result in taking or not, when done with the aid or accompaniment of any weapon, projectile, or other device or instrumentality; and every attempt to take and every act of assistance to any other person in taking or attempting to take wildlife, when done with the aid or accompaniment of any weapon, projectile, or other device or instrumentality. "Wildlife" as used in this subdivision means "wildlife" as that term is defined in subdivision six of section 11-0103 of the environmental conservation law.
2. "Intoxicated condition" shall mean the presence of .08 of one per centum or more by weight of alcohol in a person's blood as shown by chemical analyses of his blood, breath, urine, or saliva made pursuant to section 11-1205 of this title. An "impaired condition" shall mean a state of impairment of a person's capacity to think or act correctly, or of a loss, even in part of a person's control of his physical or mental faculties due to his consumption of alcohol or use of a drug.
3. "Drug" means "drug" as that term is defined in section one hundred fourteen-a of the vehicle and traffic law.
4. "License to hunt", or "permit to hunt" means any license, permit, or other privilege granted pursuant to section 11-0701 of this article which authorizes the holder to hunt wildlife.
