Section 13-14-109 - [Effective 1/1/2025] Fees and costs(1)(a) The court may assess a filing fee against a petitioner seeking relief pursuant to this article 14; except that the court may not assess a filing fee against a petitioner if the court determines the petitioner is seeking the protection order as a victim of domestic violence, stalking, or sexual violence. The court shall provide the necessary number of certified copies at no cost to petitioners.(b) The court shall neither award any costs nor assess any fees, including attorney fees, against a petitioner seeking relief pursuant to this article 14, except as provided in subsection (1)(a) of this section and section 13-17-102 (2), (4), and (6).(2) A state or public agency shall not assess fees for service of process against a petitioner seeking relief pursuant to this article 14 as a victim of domestic violence as defined in section 18-6-800.3 (1), stalking, or sexual violence.(3) At the permanent protection order hearing, the court may require the respondent to pay the filing fee and service-of-process fees, as established by the state agency, political subdivision, or public agency pursuant to a fee schedule, and to reimburse the petitioner for costs incurred in bringing the action.Amended by 2024 Ch. 330,§ 9, eff. 1/1/2025.Added with relocated provisions by 2013 Ch. 218, §15, eff. 7/1/2013.This section is similar to former § 13-14-102 (21) as it existed prior to 2013.
