Section 13A-1040 - Drunkenness and other incapacitation offenses(a) A person subject to this title who is drunk on duty shall be punished as a court-martial may direct.(b) A person subject to this title who, as a result of indulgence in an alcoholic beverage or drug, is incapacitated for the proper performance of duty shall be punished as a court-martial may direct.(c) A person subject to this title who is a prisoner and, while in such status, is drunk shall be punished as a court-martial may direct.Added by 2020 Md.
