Section 18-202 - Membership(a) The County Commissioners shall appoint five members to the Board.(b)(1) Of the members of the Board: (i) at least one shall be from each of the County Commissioner districts; and(ii) one shall be at large.(2) Each member of the Board shall be a registered voter of the county.(3) Preferably, at least one member of the Board before being appointed shall have some familiarity or experience with the alcoholic beverages industry.(c)(1) In this subsection, "direct or indirect interest" means an interest that is proprietary or obtained by a loan, mortgage, or lien or in any other manner.(2) A member of the Board may not:(i) have a direct or indirect interest in or on a premises where alcoholic beverages are sold;(ii) have a direct or indirect interest in a business wholly or partly devoted to the sale of alcoholic beverages;(iii) own stock in: 1. a corporation that has a direct or indirect interest in a premises where alcoholic beverages are sold; or2. a business wholly or partially devoted to the sale of alcoholic beverages;(iv) hold any other public office or employment; or(v) solicit or receive, directly or indirectly, a commission, remuneration, or gift from: 1. a person engaged in the sale of alcoholic beverages or an agent or employee of the person; or(3) A person engaged in the manufacture or sale of alcoholic beverages, an agent or employee of the person, or a license holder may not directly or indirectly offer a commission, remuneration, or gift to:(i) a member of the Board; or(ii) someone on behalf of a member of the Board.(d)(1) The term of a member is 4 years.(2) A member may not serve more than two consecutive terms.(3) The terms of the members are staggered as required by the terms provided for members of the Board on July 1, 2016.(e) The County Commissioners may remove a member for:(1) a violation of subsection (c) of this section or other misconduct in office;(3) willful neglect of duty.Added by 2016 Md.
