Section 901D.6 - Authority to order program participation1. A court or governmental entity, or an authorized officer thereof, in a participating jurisdiction may utilize the program as provided in this section. The program shall be a preferred program for offenders charged with or convicted of an eligible offense.2. A court may condition any bond or pretrial release otherwise authorized by law for a person charged with an eligible offense upon participation in the program and payment of the fees established pursuant to section 901D.4.3. A court may condition a suspended sentence or probation otherwise authorized by law for a person convicted of an eligible offense upon participation in the program and payment of the fees established pursuant to section 901D.4.4. The board of parole, the department of corrections, or a parole officer may condition parole otherwise authorized by law for a person convicted of an eligible offense upon participation in the program and payment of the fees established pursuant to section 901D.4.Added by 2017 Iowa, ch 76, s 8, eff. 7/1/2017.
