Iowa Code § 222.65

Section 222.65 - [Repealed Effective 7/1/2025] Investigation

If an application is made for placement of a person in a state resource center or special unit, the department shall immediately investigate the residency of the person and proceed as follows:

1. If the department concurs with a certified determination as to residency of the person in another state or in a foreign country, or the person's residence is unknown under section 222.60, the department shall cause the person either to be transferred to a resource center or a special unit or to be transferred to the place of foreign residency.
2. If the department disputes a certified determination of residency, the department shall order the person transferred to a state resource center or a special unit until the dispute is resolved.
3. If the department disputes a certified determination of residency, the department shall utilize the procedure provided in section 225C.61 to resolve the dispute. A determination of the person's residency status made pursuant to section 225C.61 is conclusive.
