The commissioner or his or her designee is authorized to consider appeals of initial decisions of the department to correct errors made by the department in approving or denying any claim filed pursuant to this article upon a written request for formal review. The commissioner or his or her designee may modify or override the initial decision of the department upon a showing of an error of material fact or an abuse of discretion. The department shall be authorized to promulgate rules and regulations regarding the process and procedure for requests for formal review and appeal of initial decisions of the department. The department shall be authorized to contact other state agencies for the purpose of using the personnel and resources of such agencies to assist the commissioner or his or her designee in carrying out his or her duties under this article. Final decisions of the commissioner or his or her designee may be appealed to superior court for judicial review as set forth in Chapter 3 of Title 5, the "Superior and State Court Appellate Practice Act."
