Section 45-53-70.02 - Sale or gift of travel
(a) The Legislature declares and finds that for the public safety and welfare of the residents of Perry County, the County Commission of Perry County may sell gravel to any individual. The price for gravel shall not be less than the fair market value. The county commission shall limit the number of loads to be sold to an individual to 12 loads per calendar year. As used in this section, gravel means any earth used as road building material.
(b) For the public safety and welfare of the residents of the county, the county commission shall supply at no cost to any mobile home owner a maximum of 18 yards of gravel for the purpose of a mobile home pad. The mobile home owner shall show proof of the current mobile home ad valorem tax sticker to receive the free gravel. This subsection shall not apply to the establishment of mobile home parks.
(c) Any resident of the county who purchases gravel pursuant to subsection (a), or any mobile home owner who is supplied gravel at no cost pursuant to subsection (b), may request the county commission to deliver the gravel at no additional cost.
(d) The proceeds collected pursuant to subsection (a) shall be deposited in the county general fund and used for the general purposes of the county.
