Section 45-51-82.23 - Appointment of committee or advisory council
(a) The Presiding Judge of the Criminal Division of the Fifteenth Judicial Circuit may appoint a committee or advisory commission comprised of at least seven citizens of counties within the circuit which shall be known as the Citizens Advisory Commission on Prosecution. The committee or commission shall serve at the pleasure of the appointing authority for the circuit, and shall make recommendations to the district attorney concerning which defendants shall be eligible or shall not be eligible for preprosecution or pretrial diversion based upon criteria established by the district attorney and the committee, and upon its consideration of factors enumerated in Section 45-51-82.22.
(b) The committee or commission shall serve without personal profit, but may be paid from the district attorney's fund for actual expenses incurred in connection with its duties.
(c) At least one member shall be appointed by the recommendation of the presiding judge of the circuit, and at least one member shall be appointed upon the recommendation of the board of directors of the bar association of the county comprising the circuit. (Act 1978, No. 706, p. 1015, § 4.)
