Section 45-49-161.03 - Abolishing the Office of the Mobile County Treasurer
(a) Upon the expiration of the current term of office of the Mobile County Treasurer, or if a vacancy occurs for any reason in the office prior to the expiration of the current term of office, the office of the Mobile County Treasurer is abolished.
(b) Upon the abolition of the office of Mobile County Treasurer, the Mobile County Commission shall perform all acts, duties, and functions required by law to be performed by the treasurer. All records, assets, and property held in the name of the county treasurer shall be transferred to the Mobile County Commission and all merit employees of the Mobile County Treasurer shall become employees of the Mobile County Commission.
(c) All county depositories appointed as of the date of abolition of the office of Mobile County Treasurer shall continue to serve as county depositories until such time as the Mobile County Commission, by resolution, shall remove any depository.
(d) It is the purpose of this section to preserve revenue and promote public convenience in Mobile County by abolishing the office of Mobile County Treasurer and consolidating the functions of the office into the existing offices of the Mobile County Commission.
(e) Upon the abolition of the office of Mobile County Treasurer, the Mobile County Commission shall commission an audit of the accounts of the Mobile County Treasurer. The Mobile County Commission shall not assume any liability for errors or omissions attributable to the acts or omissions of the Mobile County Treasurer.
