Section 45-37-91.04 - Board of directors(a) The affairs of the bureau shall be managed by a board of directors, called the board, that shall consist of the following: (1) A member of the House of Representatives representing the county chosen by members of the House representing the county.(2) A member of the Senate representing a senatorial district that includes a portion of the county chosen by the Senators representing the senatorial districts that include a portion of the county.(3) An elected official of the largest city in the county chosen by the governing body of that city.(4) A member of the governing body of the county chosen by that governing body.(5) The Chair of the Board of Directors of the Civic Center Authority, established by Part 1.(6) The president of the chamber of commerce.(7) The president of the city motel-hotel association.(8) The individual representing the classification of the motel-hotel business on the board of directors of the chamber of commerce .(9) Four members, called members at large, appointed in the manner prescribed in this part.(b)(1) In the event that another county with area within the metropolitan area of the largest city comes under this part pursuant to Section 45-37-91.03, by providing funding, the county commission of that county shall be entitled to appoint members to the board increasing the total number of directors by two, and the two additional members shall serve at the pleasure of the appointing body.(2) One additional member of the board shall be the mayor, or his or her designee, of the city in the county having the second largest population in the county according to the most recent or any subsequent federal decennial census. This member shall participate in the appointment of the directors at large in addition to the eight members of the board designated in subsection (a).(c) The representative, senator, elected official of the largest city, and the member of the governing body of the county shall be elected for terms on the board expiring when their respective terms as elected public officials expire. A person may succeed himself or herself as a director.(d) As used in this section, the term "eight members" is the eight members of the board designated in subdivisions (1) to (8) of subsection (a). (e)(1) The eight members shall number the directorships at large as follows: a. Directorship at large No. 1.b. Directorship at large No. 2.c. Directorship at large No. 3.d. Directorship at large No. 4.(2) The eight members shall appoint the directors at large from qualified electors of the county.(f) As used in this section, the term "effective date hereof" is the date on which the provision creating the directorships at large becomes applicable to the county. The first terms for the directorships at large shall run from the first day of the calendar month next succeeding the effective date hereof, irrespective of the date on which the directors at large are appointed.(g) The first term of directorship at large No. 1 shall be for one year. The first term for directorship at large No. 2 shall be for two years. The first term for directorship at large No. 3 shall be for three years. The first term for directorship at large No. 4 shall be for four years.(h) After the first terms for directorships at large numbered 1, 2, 3, and 4 expire, all subsequent terms shall be terms of four years, the first four-year terms shall commence on the day the first terms for the respective directorships expire.(i) Every individual designated, or appointed, as a director shall serve until his or her successor is appointed and qualifies.(j) In the event of a vacancy on the board, the body or persons appointing the director who immediately prior to the vacancy occurring held the directorship becoming vacant shall appoint one to fill the vacancy and serve for the unexpired term.(k) The members of the board shall serve without compensation but may be reimbursed for actual expenses incurred in the performance of their duties for the bureau.Ala.
