Section 131375 - Local health department access to the state syndromic surveillance system(a) To support local public health activities, the department shall provide each local health department as near as possible to real-time access to its jurisdiction's data entered into the state syndromic surveillance system.(b) The department, at its discretion, may approve the sharing of data collected pursuant to Section 131370 with all of the following entities: (1) State governmental entities.(2) Local health departments.(3) Specified entities as defined in Section 131360 authorized by the department, if access is limited to the specified entity's own data.(c) The department, at its discretion, may approve the sharing of data collected pursuant to Section 131370 with persons with a valid scientific interest who are engaged in demographic, epidemiological, or other similar studies related to health. Persons with a valid scientific interest who are engaged in demographic, epidemiological, or other similar studies related to health that are interested in receiving data collected pursuant to Section 131370 shall submit a request to and obtain the approval of the Committee for the Protection of Human Subjects.(d) Notwithstanding Section 1798.24 of the Information Practices Act of 1977 (Chapter 1 (commencing with Section 1798) of Title 1.8 of Part 4 of Division 3 of the Civil Code), the department, at its discretion, may approve the sharing of data collected pursuant to Section 131370 with the CDC, if the CDC agrees in writing to maintain the confidentiality of the data before confidential data is disclosed.Ca.
