Section 47612 - Appropriation of public money; average daily attendance(a) A charter school shall be deemed to be under the exclusive control of the officers of the public schools for purposes of Section 8 of Article IX of the California Constitution, with regard to the appropriation of public moneys to be apportioned to any charter school, including, but not necessarily limited to, appropriations made for purposes of this chapter.(b) The average daily attendance in a charter school may not, in any event, be generated by a pupil who is not a California resident. To remain eligible for generating charter school apportionments, a pupil over 19 years of age shall be continuously enrolled in public school and make satisfactory progress towards award of a high school diploma. The state board shall, on or before January 1, 2000, adopt regulations defining "satisfactory progress."(c) A charter school shall be deemed to be a "school district" for purposes of Article 1 (commencing with Section 14000) of Chapter 1 of Part 9 of Division 1 of Title 1, Section 41301, Section 41302.5, Article 10 (commencing with Section 41850) of Chapter 5 of Part 24 of Division 3, Section 47638, and Sections 8 and 8.5 of Article XVI of the California Constitution.(d) For purposes of calculating average daily attendance, no pupil shall generate more than one day of attendance in a calendar day. Notwithstanding any other law, a charter school that operates a multitrack calendar shall comply with all of the following: (1) Calculate attendance separately for each track. The divisor in the calculation shall be the calendar days in which school was taught for pupils in each track.(2) Operate no more than five tracks.(3) Operate each track for a minimum of 175 days. If the charter school is a conversion school, the charter school may continue its previous schedule as long as it provides no fewer than 163 days of instruction in each track.(4) For each track, provide the total number of instructional minutes, as specified in Section 47612.5.(5) No track shall have less than 55 percent of its schooldays before April 15.(6) Unless otherwise authorized by statute, no pupil shall generate more than one unit of average daily attendance in a fiscal year.(e) Compliance with the conditions set forth in this section shall be included in the audits conducted pursuant to Section 41020.Amended by Stats 2013 ch 357 (SB 97),s 33, eff. 9/26/2013.Amended by Stats 2013 ch 48 (AB 86),s 36, eff. 7/1/2013.Amended by Stats 2003 ch 892 (AB 1137), s 11, eff. 1/1/2004.Amended by Stats 2002 ch 36 (AB 168), s 1, eff. 5/9/2002.Section 47612, as added by Stats 2002 ch 36 (AB 168), s 2, eff. 5/9/2002, was repealed by Stats 2003 ch 892 (AB 1137), s 12, eff. 1/1/2004.
