Section 27-51-1206 - Pedestrians prohibited on controlled-access highway - Definitions(a) As used in this section: (1) "Construction personnel" means an employee of the Arkansas Department of Transportation or a contractor of the State Highway Commission;(2) "Controlled-access highway" means a state highway or street that: (A) Is designed for an unhindered flow of traffic without intersections, traffic signals, or property access; and(B) Regulates the ingress and egress of a motor vehicle;(3) "Highway work zone" means an area upon or adjacent to a highway or street of this state where construction, reconstruction, maintenance, or any other type of work is being performed by construction personnel; and(4)(A) "Pedestrian" means a person afoot.(B) "Pedestrian" does not include a person who is the driver or passenger of a motor vehicle traveling on a controlled-access highway.(b) A pedestrian shall not be within the property boundaries of a controlled-access highway unless he or she is: (1) Directed by a police officer; or(2) Construction personnel in a highway work zone.(c) A person who violates this section, upon conviction shall pay a fine not to exceed one hundred dollars ($100).(d) It is a defense to prosecution under this section that the pedestrian was first within a motor vehicle upon the controlled-access highway and exited the motor vehicle due to a mechanical breakdown, a motor vehicle accident, or other emergency.Added by Act 2023, No. 779,§ 1, eff. 8/1/2023.
