Section 15-75-320 - Sales restrictions(a) No dealer shall sell or offer for sale liquefied petroleum gas or conduct liquefied petroleum gas operations of any type in any area of this state in which certified personnel are not readily available for proper and efficient service to the users' containers, systems, or appurtenances.(b) Each existing or new permit issued by the Liquefied Petroleum Gas Board shall designate accurately the county or counties in which the holder may conduct liquefied petroleum gas operations.(c) No dealer shall sell or offer for sale liquefied petroleum gas or conduct liquefied petroleum gas operations of any type in any county or counties not shown on and authorized by a current permit.(d)(1) Any dealer desiring to enlarge or expand liquefied petroleum gas service beyond his or her permitted counties may add a contiguous county to his or her permit by: (A) Providing thirty (30) days' written notice of his or her intention to the director; and(B) Paying a permit fee of three hundred dollars ($300) for each additional county to be included under the permit.(2) The director shall report any additional counties included under a class one permit issued under subdivision (d)(1) of this section to the board at its next meeting.Acts 1965, No. 31, § 25; A.S.A. 1947, § 53-724; Acts 1999, No. 1577, § 10; 2001, No. 1219, § 2; 2007, No. 733, § 8.
