Section 15-43-329 - Taking fish from enclosed lake or pond - Posting(a) If any person shall take fish from any enclosed or artificial lake or pond of water belonging to any other person, without the consent of the owner, he or she shall be deemed guilty of a misdemeanor. Upon conviction, he or she shall be fined in the sum of one hundred dollars ($100) or be imprisoned in the county jail not more than thirty (30) days.(b) Before any person shall have the benefit of this section, he or she shall first give notice of his or her intention to breed or cultivate fish in the enclosed or artificial lake or pond of water; he or she shall post three (3) or more notices in the precinct of the enclosed or artificial lake or pond of water of his or her intention, warning all persons not to take fish from the lake or pond.Acts 1875, No. 69, §§ 1, 2, p. 158; C. & M.
