Section 41-256 - Authority to refuse to perform notarial actsA. A notarial officer may refuse to perform a notarial act if the notarial officer is not satisfied that either:1. The individual executing the record is competent or has the capacity to execute the record.2. The individual's signature is knowingly and voluntarily made.B. A notarial officer may refuse to perform a notarial act unless refusal is prohibited by any law other than this article.Added by L. 2021, ch. 66,s. 10, eff. 7/1/2022.
