Section 36-1313 - Action against physician license or health care institution license; prohibitionA. Notwithstanding any other law, a state regulatory board may not revoke, fail to renew or take any other action against a physician's license issued pursuant to title 32, chapter 13 or 17 based solely on a physician's recommendation to an eligible patient regarding or prescription for or treatment with an investigational drug, biological product or device.B. Notwithstanding any other law, a state agency may not take any action against a health care institution's license based solely on the institution's participation in the treatment or use of an investigational drug, biological product or device under this chapter.Added pursuant to 2014 Ballot Proposition 303, November 4, 2014.
