Section 28-7056 - Dumping trash on highways or airports; classificationA. A person who dumps, deposits, places, throws or leaves refuse, rubbish, debris, filthy or odoriferous objects, substances or other trash on a state or county highway, road, public thoroughfare, public airport, the right-of-way to a state or county highway, road, public thoroughfare or public airport or within twenty yards of a state or county highway, road, public thoroughfare or public airport is guilty of a class 3 misdemeanor.B. If a class 3 misdemeanor is committed as provided in subsection A from a motor vehicle or aircraft, the driver of the vehicle or pilot of the aircraft is presumed to be the offender.C. The director, the board of supervisors of each county and the governing body of each city or town shall cause signs to be erected at suitable intervals on highways, airports and public thoroughfares in their respective areas of authority, including public parks, informing the public that it is unlawful to commit the acts prohibited by subsection A.D. The highway patrol, the sheriff's office of each county and the peace officers of each city or town shall enforce this section.
