Rule 4.03 - Restitution undertaking by appellee (a) In an action on a contract for the payment of money only, or in an action for injuries to the person, if appellee gives adequate security to make restitution in case the judgment is reversed or modified, appellee may, on leave obtained from the trial court, proceed to enforce the judgment notwithstanding the execution of a supersedeas bond. This security must be an undertaking executed to appellant, with sufficient surety, to the effect that if the judgment be reversed or modified appellee will make full restitution to appellant of the money received under the judgment. (b) The provisions of paragraph (a) shall not apply to judgments recovered in actions for libel, slander, malicious prosecution, false imprisonment or assault and battery.
