Rule 29.07 - Assignment of Presiding and Resolution Judge in Business Litigation(a) An order from the Chief Justice granting a Motion to Refer is a transfer of Business Litigation to the Division. Upon receipt of the order, the Division Chair shall, with the advice and consent of the Division, enter an order assigning Presiding and Resolution Judges. The Division Chair may serve as a Presiding or Resolution Judge. (b) Upon referral by the Chief Justice and assignment by the Division Chair, the Presiding Judge is authorized, pursuant to Article VIII § 3 of the West Virginia Constitution, to preside over the action in any county that is within the same Business Litigation Assignment Region in which the case is filed.W.Va.
