Rule 38 - Change of Venue

On motion by one of the parties or on the judge's initiative, the venue of a probate court proceeding may be changed to another district by court order for the convenience of the parties, witnesses and counsel, and in the interest of justice. No change of venue is effective unless the case is accepted by the court to which it will be transferred. If venue is changed, the court must send to the transferee court, without charge, the documents on file including the original of any unprobated will. Notices published in the sending district before the change of venue shall be effective, but such further notices that may be required by law or these rules to be published in the district of the proceeding shall be filed in both the sending and transferee districts.
