Rule 25 - Substitution of Parties
(a) Death. If a party dies and the party's interest is not thereby extinguished, the court may order substitution of the proper parties. A motion for substitution may be made by any party or by the successors or representatives of the deceased party and shall be served on the parties as provided in Rule 5 and upon persons not parties in the manner provided in Rule 4.
(b) Representative. Except as otherwise provided, the court may, for good cause shown, replace a representative of a party authorized by Rule 18, or substitute a representative for a party at any time.
(c) Transfer of interest. A party who transfers an interest such that the transferee becomes an interested person shall give notice of the transfer to all other parties. The original party may continue unless the court upon motion directs the person to whom the interest is transferred to be substituted in the proceeding or joined with the original party. Service of the motion shall be made as provided in subdivision (a) of this rule.
(d) Public officers; death or separation from office. When a public officer is a party to a proceeding in his official capacity and during its pendency dies, resigns, or otherwise ceases to hold office, the officer's successor is automatically substituted as a party. An order of substitution may be entered at any time, but the omission to enter such an order shall not affect the substitution.
