Rule Administrative Order No. 27 - Guidelines for Summary Disposition of Appeals

Pursuant to the Vermont Constitution ch. II, §§ 30 and 37, the Supreme Court hereby issues the following Administrative Order, effective May 1, 1991.

The following guidelines have been established to assist the Court and parties appearing before the Court in deciding which matters are appropriate for oral argument before a panel of three justices, limitations on briefing, limitations on oral argument, issuance of an entry order or brief per curiam opinion, or any combination of the above.

A full opinion, issued after full briefing and oral argument, may be appropriate when any one of the following circumstances is present:

(a) The Court may be establishing a new rule of law, altering or modifying an existing rule, or applying an established rule to a novel fact situation.
(b) The matter on appeal involves a legal issue of substantial public interest.
(c) The Court may be criticizing existing law.
(d) The Court may be resolving a conflict or apparent conflict of authority between panels of the Court.
