Rule 3 - Procedures [for] Processing Probate Matters, Maintaining Records, and Submitting Reports of the Courts

Subject to the approval of the Chief Justice, the Office of Court Administration shall establish procedures for processing probate matters, for maintaining records by all probate courts, and for furnishing information and statistical data relative to the work of the courts and to the expenditure of public moneys for their maintenance and operation.

The Probate Courts shall keep in their respective offices a standardized file, as prescribed by the Office of Court Administration, in which there shall be entered all matters which are instituted in the probate court.

As soon as a matter is initiated in the probate court it shall receive a number in keeping with such case numbering system as Court Administration shall develop for the probate courts. All papers pertaining to a matter must be kept together in a folder bearing the uniform case number and filed sequentially as directed by Court Administration.

Failure to comply with the requirements of the Rule, or any procedures established thereto, shall subject the party so failing to penalties as for contempt of Court.
