Rule 12 - Waiver or Certification - Juvenile Drug Offenders

A child age sixteen (16) years of age or older who has been found delinquent of having committed one (1) felony offense after the age of sixteen (16) involving the unlawful sale, distribution, manufacture, delivery, or possession with intent to manufacture, sell, distribute, or deliver any controlled substance listed in Schedule I or II of G.L. 1956 § 21-28-2.08, shall be either certified pursuant to G.L. 1956 § 14-1-7.2 or waived pursuant to G.L. 1956 § 14-1-7.1 for all subsequent felony offenses involving the unlawful sale, distribution, manufacture, delivery, or possession with intent to manufacture, sell, distribute, or deliver any controlled substance. Upon the filing of an appropriate motion, the court shall conduct a hearing in accordance with the applicable statute and Rules 13 and 14.
