Rule 1035.2(a) - Motion for Summary Judgment(1) A motion for summary judgment shall be filed with the clerk of courts, and shall be accompanied by a supporting brief. A copy of the motion and brief shall be delivered to the court administrator's office for transmittal to the assigned judge.(2) Any party opposing the motion shall file a response along with a supporting brief, within thirty (30) days after service of the motion. If a response is not filed as provided above, the court may treat the motion as uncontested.(3) If movant does not file a supporting brief, the non-moving party need not do so, and the court may consider the movant to have abandoned the request for relief.(4) After a response to the motion is filed or after the response period has elapsed, the assigned judge may schedule the motion for oral argument. If so, written notice of the argument date will be given to counsel for the parties and to any unrepresented parties.Amended effective 1/1/2020; amended effective 7/1/2023.
