Rule 39-2205 - Wrongful Death Actions

Notice. When an action for wrongful death has been instituted, the plaintiff shall give notice to each person entitled by law to share in the damages recoverable in such action, unless such notice be waived, that an action has been instituted for wrongful death, naming the decedent and stating the Court, term and number of action. When the address of the person to be notified is known, said notice shall be given by registered mail with return receipt requested, and, in such manner as the Court may direct by special Order made upon Petition of the plaintiff setting forth the fact that the address of the person to be notified is unknown Proof of the giving of such notice shall be made by affidavit of plaintiff or the attorney for the plaintiff, and in the case of notice sent by registered mail, by attaching the return receipt to such affidavit. Proof of notice shall be filed in the office of the Prothonotary with other papers in the case.
