Rule 305 - PRE-TRIAL DISCOVERY

Within fourteen (14) days of arraignment, all parties shall send a written request to the opposing party for information required under 305 of the Pennsylvania Rules of Criminal Procedure. When there are items requested by one party which the other party refuses to disclose, the demanding party may then make appropriate motion to the court as part of its omnibus pre-trial motion. In such a motion the party must set forth the fact that a good faith effort to discuss the request of material has taken place and proved unsuccessful. Further, the motion shall set forth the fact that a written request was made to the other party within fourteen (14) days of arraignment.
