Rule 3183 - Stay Of Execution, Setting Aside Execution
(g) Whenever, prior to sheriffs sale on a residential mortgage obligation, the default shall be cured pursuant to 404 of the Act of January 30, 1974, No. 16 (41 P.S. Sec 404), the mortgagee or his attorney shall sign a Praecipe prepared by or on behalf of the mortgagor to vacate the judgment. The Praecipe shall be in substantially the following form:

PRAECIPE TO VACATE JUDGMENT UPON CURING OF DEFAULT ON RESIDENTIAL MORTGAGE

OFFICE OF JUDICIAL SUPPORT:

Vacate the judgment in the above-captioned matter without prejudice pursuant to the attached court order.

ORDER

Effective (date), it appearing that the default on the residential mortgage forming the subject of this suit has been cured pursuant to 404 of the Act of January 30, 1974, No. 6, the Office of Judicial Support is hereby directed to mark the judgment previously entered herein as follows: "Vacated without prejudice to the continuing validity and lien priority of the mortgage held by the plaintiff which was the subject matter of this action and without prejudice to the institution by the plaintiff of a new proceeding under the mortgage loan documents upon a default hereafter occurring."
