Rule 16.025 - TRIALS BY DECLARATION(1) Testimony by declaration shall be allowed in violation cases only upon receipt of a signed request from the defendant five (5) or more days before the scheduled violation trial. The defendant's request must clearly waive the right to submit oral testimony in court in favor of a written statement. (2) Any declaration submitted by any party or witness must include the following language in prominent letters immediately above the signature of the declarant: "I hereby declare that the above statement is true to the best of my knowledge and belief, and that I understand it is made for the use as evidence in court and is subject to penalty for perjury."(3) Declarations that do not include the language quoted in (2) above will not be considered by the court.Polk Cnty.
