Rule 16.005 - TESTIMONY BY AFFIDAVIT OR DECLARATION UNDER PENALTY OF PERJURY

If a signed waiver is filed by the alleged violator, testimony in a traffic violation trial is allowable by affidavit or by declaration under penalty of perjury pursuant to ORS 153.080. A copy of the affidavit or declaration shall be provided to the alleged violator before trial.
