A petition seeking the appointment of a guardian for a minor who is either (a) a member of an Indian tribe or (b) eligible for membership in an Indian tribe and a biological child of a member of an Indian tribe shall contain a statement that the Indian Child Welfare Act (ICWA) applies to the protective proceeding.
