Rule 9.6 - Court clerk's duty to forward the record Upon the filing of the notice of appeal, the justice or municipal court clerk shall immediately forward to the clerk of the district court the required filing fee and the appeal cost bond, together with the record.
(a) The record consists of any papers and exhibits filed in the justice or municipal court, the court minutes, and the docket entries made by the clerk, including but not limited to: (1) The notice of appeal;(3) Any court minutes; and(b) Except in non-small claims civil appeals from justice court, transcripts are not required and will not be prepared except at the request of a party or the district court hearing the appeal.(c) In summary eviction appeals, transcripts are not required; however, the justice or municipal court shall make available any electronic recording of proceedings without transcription upon request by the district court.Adopted April 26, 2024, effective 6/25/2024.
