Rule 6-444 - Petition for Partition or Sale of Property(a) Petition. When two or more heirs or legatees are entitled to distribution of undivided interests in property of the estate, the personal representative or one or more of the heirs or legatees may petition the court before the closing of the estate to order partition of the property or sale of the property in lieu of partition. The petition shall contain a brief description of the property and the relief requested. It shall be served on all interested heirs and legatees.(b) Disposition. The court shall determine whether there shall be partition or sale and shall thereafter proceed pursuant to Title 12, Chapter 400.Md. R. Estate Settlem. 6-444
