Rule 1-303 - Form of Oath

Except as provided in Rule 1-333(c)(3), in Rule 5-603, or by other law, whenever an oral oath is required by rule or law, the person making oath shall solemnly swear or affirm under the penalties of perjury that the responses given and statements made will be the whole truth and nothing but the truth. A written oath shall be in a form provided in Rule 1-304.

This Rule is derived from former Rules 5 c and 21 and is in part new.

HISTORICAL NOTES

2001 Orders

The March 5, 2001, order designated the existing text as section (a); in section (a), inserted "Except as provided in section (b),; added section (b); and amended the source note.

2002 Orders

The October 31, 2002, order deleted the section (a) designator; in the first sentence, substituted "Rule 16-819(d)(3) for "section (b); deleted section (b), which previously read: "A court interpreter shall solemnly swear or affirm under the penalties of perjury to interpret accurately, completely, and impartially.; and inserted the cross reference.

2015 Orders

The March 2, 2015, order amended the Rule to revise internal references.
