Rule 1-101 - [Effective 1/1/2025] Applicability
(a)Title 1. Title 1 applies to all matters in all courts of this State, except the Orphans' Courts and except as otherwise specifically provided.
(b)Title 2. Title 2 applies to civil matters in the circuit courts, except for Juvenile Causes under Title 11 Chapters 100, 200, 400, and 500 of these Rules and except as otherwise specifically provided or necessarily implied.
(c)Title 3. Title 3 applies to civil matters in the District Court, except as otherwise specifically provided or necessarily implied.
(d)Title 4. Title 4 applies to criminal matters; post conviction procedures; and expungement of records in the District Court and the circuit courts, including records of civil offenses or infractions, except juvenile offenses, under a State or local law enacted as a substitute for a criminal charge.
(e)Title 5. Title 5 applies to all actions in the courts of this State, except as otherwise provided by statute or rule.
(f)Title 6. Title 6 applies to matters in the Orphans' Courts and before the registers of wills relating to the settlement of decedents' estates.
(g)Title 7. Title 7 applies to appellate and other judicial review in the circuit courts.
(h)Title 8. Title 8 applies to appellate review in the Court of Supreme Court and the Appellate Court.
(i)Title 9. Title 9 applies to proceedings under Code, Family Law Article, Title 5, Subtitle 3, Parts III and IV (Adoption without Prior Termination of Parental Rights and Adoption after Termination of Parental Rights); proceedings under Code, Family Law Article, Title 5, Subtitles, 3A (Private Agency Guardianship and Adoption) and 3B (Independent Adoption); proceedings for termination of parental rights under Code, Family Law Article, Title 5, Subtitle 14; proceedings relating to divorce, annulment, alimony, child support, and child custody and visitation; and proceedings under Code, Family Law Article, Title 4, Subtitle 5 (Domestic Violence).
(j)Title 10. Title 10 applies to fiduciary matters in the courts of this State, except for matters relating to the settlement of decedents' estates governed by Title 6 of these Rules and guardianships governed by Title 9 of these Rules.
(k)Title 11. Title 11 applies to juvenile causes and expungement of juvenile records under Code, Courts Article, Title 3, Subtitles 8, 8A, and 8C; public agency guardianships under Code, Family Law Article, Title 5, Subtitle 3, Part II; and criminal proceedings against an adult under Code, Courts Article, §§ 3-828 and 3-8A-30 and Code, Education Article, § 7-301.
(l)Title 12. Title 12 applies to property actions relating to writs of survey, lis pendens, actions for release of lien instruments, condemnation, mechanics' liens, partition, redemption of ground rents, replevin, detinue, severed mineral interests, and actions to quiet title.
(m)Title 13. Title 13 applies to proceedings relating to estates of assignees and receivers.
(n)Title 14. Title 14 applies to proceedings relating to sales of property.
(o)Title 15. Title 15 applies to special proceedings relating to arbitration, catastrophic health emergencies, contempt, coram nobis, habeas corpus, health claims arbitration, injunctions, judicial releases of individuals confined for mental disorders, mandamus, the Maryland Automobile Insurance Fund, name changes, structured settlement transfers, and wrongful death.
(p)Title 16. Title 16 applies to court administration.
(q)Title 17. Title 17 applies to alternative dispute resolution proceedings in civil actions in the District Court, a circuit court, an orphans' court, and the Appellate Court, except for actions or orders to enforce a contractual agreement to submit a dispute to alternative dispute resolution. Title 17 also applies to collaborative law processes under the Maryland Uniform Collaborative Law Act.
(r)Title 18. Title 18 applies to justices, judges and judicial appointees.
(s)Title 19. Title 19 applies to attorneys.
(t)Title 20. Title 20 applies to electronic filing and case management in the trial and appellate courts of this State as specified in Rule 20-102.
(u)Title 21 Title 21 applies to remote electronic participation in judicial proceedings conducted in the Supreme Court, the Appellate Court, a circuit court, or the District Court.

HISTORICAL NOTES

2001 Orders

The November 1, 2001, order added section (q), relating to Title 17.

2002 Orders

The January 8, 2002, order, in section (k), substituted "Subtitles 8 and 8A for "Subtitle 8.

2005 Orders

The April 5, 2005, order, in section (o), inserted "catastrophic health emergencies,.

2007 Orders

The June 4, 2007, order rewrote section (i) to conform to the revisions in Title 9; and, in section (j), deleted "with the right to consent to adoption. Section (i) previously read:

"(i) Title 9. Title 9 applies to adoptions, guardianships with the right to consent to adoption and proceedings relating to divorce, annulment, alimony, child support, and child custody and visitation.

The December 4, 2007, order rewrote section (d) to apply to expungement of certain records of civil offenses or infractions. Section (d) previously read:

(d) Title 4. Title 4 applies to criminal matters, post conviction procedures, and expungement of records in the District Court and the circuit courts.

2013 Orders

The May 1, 2013, order amended to provide for the applicability of Title 20.

The October 17, 2013, order, amended section (q) to conform to revisions of Title 17.

2015 Orders

The March 2, 2015, order, added a reference to Code, Family Law Article, Title 4, Subtitle 5; added language referring to expungement of juvenile records; and added collaborative law process to the applicability of Title 17.

The December 7, 2015, order added references to cora nobis and structured settlement transfers.

2016 Orders

The June 6, 2016, order revised the applicability of Title 16, by adding statements of the applicability of Titles 18 and 19, and by making stylistic changes.

The December 13, 2016, order, added severed mineral interests and actions to quiet title to the statement of the applicability of Title 12(l).

2018 Orders

The April 9, 2018 order amended the Rule by adding a reference to an orphans' Court in (q), and made stylistic changes.

The December 4, 2018 order amended (i) to add proceedings for termination of parental rights under Code, Family Law Article, Title 5, Subtitle 14 to the list of proceedings to which the Rules in Title 9 are applicable.
