Rule 80B - Creditors' Claims against Decedents' Estates(a) Notice to Creditors. The notice to creditors required by section 3-801 of the Probate Code shall be published by the register in the personal representative's behalf upon written request and tender of fees. (b) Written Statement. If a claimant wishes to present a claim by filing the written statement of claim provided by section 3-804 of the Probate Code, the claimant shall, within the time limits of 3-803 of the Probate Code, file with the register the official form for a Statement of Claim. (c) Proceedings By and Against the Personal Representative. Proceedings brought by claimants under section 3-807(a) of the Probate Code for payment of claims that have been allowed are formal probate proceedings under these rules. Proceedings brought by claimants under section 3-804(2) of the Probate Code to obtain payment of claims that have not previously been granted, or under section 3-806 of the Probate Code to obtain payment of claims that have been presented and disallowed, are civil proceedings under these rules. Proceedings brought by the personal representative under section 3-806(b) of the Probate Code for allowance of claims are civil proceedings.Amended effective 3/1/1988.
