Advisory Notes - 2015

Rule 2.13 is drawn from 1993 Canon 3(C)(4), but with much more detail, particularly addressing (1) appointment of persons who have made contributions in Probate Judge elections, and (2) listing exceptions to the prohibitions on appointments. The appointments addressed in this Rule are those where the appointment is made and compensation, if any, is set or is subject to approval by the court for services to be performed in specific cases pending before the court. The Rule does not apply to appointments made and compensation approved or determined by the Maine Commission on Indigent Legal Services. The Rule also does not apply to the hiring of employees of the Judicial Branch. Such hiring is governed by separate statutes, court rules, administrative orders, and collective bargaining agreements.
