Rule 10.05 - Proof of HeirshipA. Proof of heirship shall be made as provided in The Probate Act.B. A finding that there are unknown heirs will be made only after evidence is presented to establish the identity of all known heirs and that a reasonable effort has been made to ascertain the identity of unknown heirs. An Affidavit of Heirship in the case of unknown heirs shall contain a statement that a reasonable effort has been made to ascertain the identity of unknown heirs.C. If there is a change in distributive rights during the administration of an estate including a change resulting from death, renunciation, disclaimer or other election provided by law, upon motion of any person or the court's own motion, an appropriate order may be entered naming the substituted takers.Ill.
