Rule 116 - Required ElementsA conservator shall prepare accounts in the format required by Rule 26 and shall carry forward the ending balances from the last approved accounting (if any). The conservator shall include in the petition for approval of the accounting:
(1) a clear and concise statement of any restrictions by court order on the conservator's distributive powers of the conservator, citing the date of the order; (2) a statement describing how the distributions during the accounting period conformed to the restrictions imposed by the court; and (3) a statement that all distributions during the accounting period comply with the limits imposed by the court, or if any distribution did not comply, an explanation of why the distribution was made. This rule will make it easier for the court to supervise conservatorships, by placing a burden on the conservator to review and specifically set forth the restrictions on the conservator and to explain to the court just how the conservator's actions have conformed to court order.
