Rule 101 - Title, Scope, and Purpose(a) TITLE. These rules may be known as the Superior Court Rules of the Probate Division and may be cited as "Super. Ct. Prob. R. ___."(b) SCOPE. These rules apply to proceedings in the Probate Division of the Superior Court of the District of Columbia as follows:(1)All Proceedings. Chapter 1 governs all proceedings in the Probate Division.(2)Decedents' Estates. Chapter 2 governs all estates of decedents dying on or after July 1, 1995.(3)Intervention Proceedings. Chapter 3 governs all proceedings instituted under the District of Columbia Guardianship, Protective Proceedings, and Durable Power of Attorney Act.(4)Foreign Estates. Chapter 4 governs foreign estate proceedings.(5)Property and Estates of Minor Children. Chapter 5 governs proceedings regarding property and estates of minor children.(6)Trusts. Chapter 6 governs proceedings regarding trusts or trustees.(7) Proceedings Under Superseded Law.(A) Appendix A governs all estates of decedents dying prior to January 1, 1981.(B) Appendix B governs all estates of decedents dying on or after January 1, 1981 through June 30, 1995.(C) Appendix C governs proceedings regarding conservators of adults in proceedings initiated under the now-repealed D.C. Code §§ 21-1501 to -1507 ("old law conservatorships").(D) Appendix D governs commutation of dower.(c) PURPOSE. These rules should be construed, administered, and employed by the court and the parties to secure the just, speedy, and inexpensive determination of every action and proceeding.(d) APPLICABILITY OF CIVIL RULES. Except when inconsistent with these rules or the traditionally uncontested and administrative proceedings provided for in these rules, the Superior Court Rules of Civil Procedure are applicable to proceedings in the Probate Division.Adopted by Order dated March 4, 2022, effective 8/22/2022.
