(a) Response. Within fifteen days after service of the formal charges and notice of formal proceedings, the judge may file a response in the office of the commission. The executive director shall promptly prepare copies of the response for distribution to disciplinary counsel and members of the hearing panel.(b) Waiver of privilege. The raising of a mental or physical condition as a defense constitutes a waiver of medical privilege as to the particular condition at issue.(c) Extension of time. For good cause shown, the presiding member may grant an extension of time to file a response to the formal charges.(d) Failure to respond. In the event a judge fails to respond within the prescribed time, the factual allegations in the formal charges shall be deemed admitted.Ariz. R. Comm. Jud. Cond. 25
