Service upon a judge of formal charges in any disciplinary or incapacity proceeding shall be made by personal service upon the judge or judge's counsel by any person authorized by the commission chairperson, by certified mail, return receipt requested, to the judge's address of record, or using electronic mail as agreed upon by disciplinary counsel and the judge or judge's counsel. Delivery of all other papers or notices, including a request for a response to a complaint, shall be made by first class mail or electronic mail unless otherwise ordered by the commission.

RULES GOVERNING
<Proceedings commenced prior to the January 1, 2002 effective date of these new rules shall continue to be governed by the rules effective prior to the effective date until the closure of the matter.>
HISTORICAL NOTES
The former rule, adopted May 24, 1990, effective July 1, 1990, amended March 27, 1995, effective June 1, 1995, was abrogated by Order dated October 11, 2001, effective December 31, 2001. Because the former rule has continuing effect for actions begun prior to the date of repeal, the text of the rule is set out below.
"Rule 12. Application of Court Rules
"These rules, as adopted by the supreme court, shall govern all proceedings before the commission. In addition, the Arizona Rules of Evidence shall be followed as far as practicable in all formal proceedings, and Rule 122 of the Rules of the Supreme Court shall apply to all requests for electronic and photographic coverage of such proceedings. Procedural errors or defects not affecting the substantive rights of a judge shall not be grounds for invalidation of commission proceedings."
