Section 1-7 - Food Stamp Program Disqualification

(a) DFS-ORP is responsible for investigating any case of alleged Intentional Program Violation.

(b) DFS-ORP is responsible for ensuring that appropriate cases are acted upon.

(c) DFS-ORP has opted to use disqualification hearings in the following cases:

  • (i) the Agency believes the facts of the individual case do not warrant civil or criminal prosecution; or
  • (ii) cases previously referred for prosecution that were declined by the appropriate legal authority; or
  • (iii) in previously referred cases where no action was taken within a reasonable period of time and the referral was formally withdrawn by the Agency.
