Section 5-22 - Effect of imposition of Medicare sanctions on dually certified facilities

(a) Automatic imposition. If a facility is denied participation in, terminated from participation in Medicare, or otherwise sanctioned by Medicare, the Department shall impose the same remedy or remedies for purposes of Medicaid, in accordance with the provisions of 42 C.F.R. § 488.452.

(b) No separate appeal. A remedy imposed pursuant to this Section may not be appealed pursuant to Section 23 of this rule, Chapter I, or any other rules of the Department. The providers exclusive appeal is pursuant to Medicare procedures in accordance with 42 C.F.R. § 498.
