(a) "BuRec" means the United States Department of Interior, Bureau of Reclamation.
(b) "Commission" means the Wyoming Parks and Cultural Resources Commission.
(c) "Concessionaire" means an individual, corporation, partnership, association or entity who provides the general public with services, products, facilities and programs. The Concessionaire is representative of the Wyoming Division of State Parks and Historic Sites in providing enjoyment, recreational opportunities and educational experiences to the general public. The term Concessionaire is inclusive of the business and all its staff members.
(d) "Contract" means the formal written agreement which may be a lease, license, permit, or subcontract between the Concessionaire and Wyoming Division of State Parks and Historic Sites.
(e) "Department" refers to the Department of Commerce.
(f) "Department Director" means the Director of the Department.
(g) "Division" means the Wyoming Division of State Parks and Historic Sites.
(h) "Division Director" means the Director of the Wyoming Division of State Parks and Historic Sites.
(i) "Concessions Manager" means the Division staff member assigned to management of the statewide concession program.
(j) "FMV" means the Fair Market Value established through the appraisal process. It includes the capital assets as well as the going concern value of the business.
(k) "Lessee" means the individual, corporation, partnership, association or entity who leases improved or unimproved lands from the State of Wyoming.
(l) "MOU" means the Memorandum of Understanding. On May 28, 1992, the State of Wyoming, Department of Commerce, Division of State Parks and Historic Sites (Division) entered into a Memorandum of Understanding (MOU) with the United States Department of the Interior, Bureau of Reclamation (BuRec). This MOU transferred the recreational land management of six Wyoming Reclamation Reservoirs from the BuRec to the Division.
(m) "Amendment to the MOU". On February 26, 1996, an amendment to the MOU was made to include the Bureau of Reclamation's Interim Concession Management Policy and the Concession Management Guidelines (Amendment to the MOU). This amendment controls and supersedes any
(n) "Park" is an all inclusive statement to mean any or all state parks and or historic sites.
(o) "Park Master Plan" means the individual plan written for the management and development of a specific park or historic site within the State of Wyoming. A copy of the plan is available from the Park Superintendent of each park.
(p) "Park Mission Statement" means the goals for providing the general public with recreational and educational experience within a specific park or historic site while maintaining the land and facilities for the long term use and enjoyment of the general public.
(q) "RFP" means the Request for Proposal. A formal request submitted by individuals, corporations, partnerships, associations or entities to operate and/or manage certain lands and/or facilities within the Wyoming Division of State Parks and Historic Sites system. The request has specific requirements and time lines.
(r) "RFP Bid Bond" means a bond that must be purchased through an approved provider prior to submission of a RFP by any proposed Concessionaire.
(s) "RFP Receipt" means the record of date and time that a RFP is received by the Wyoming Division of State Parks and Historic Sites.
