Upon receipt of a statement of dispute, the Director shall designate a hearing officer to preside pre-hearing matters and the hearing. The hearing officer may be an employee of the Department, or an employee of another State agency. Any party may make one request that a different hearing officer be designated, provided the request is made no less than ten (10) days before the date set for the hearing.
