Section 91-2-6 - Dual Registration Of Vehicles Subject To The Title and Registration Laws of Two or More States
6.1. If the applicant is a resident of this State and is employed in an adjoining State and commutes from his residence to his place of employment in a foreign State, then where the foreign State has required registration of said vehicle in such foreign State, the vehicle should remain titled and registered in such foreign State, but should also be titled and registered in this State, in the same manner as would be required of any other resident. The foreign title would remain in our files and a West Virginia Certificate of Title would be issued to the owner of the vehicle to hold in lieu of the foreign title.
6.2. However, if the applicant is (1) a resident of a foreign State; (2) has taken temporary residence and employment or engages in any trade or occupation in West Virginia, even though he may travel periodically between his temporary residence in this State and his residence in his home State, he would be subject to the title and registration laws of this State as well as the State in which he resides. The Department would consider the applicant eligible for a dual registration. Application should be made for a West Virginia Certificate of Title in the usual manner, the original title for the vehicle issued by his home State should be submitted to this Department with the application, accompanied by a letter stating that the applicant is a resident of a foreign State and is employed and has taken temporary residence in West Virginia, and request the Department to return the foreign title to the applicant or lienholder, if the State issuing the foreign title requires the title to be returned to the lienholder.
6.3. In accordance with Chapter 17-A -Article 5 - Section 1 of the West Virginia Motor Vehicle Laws, the applicant would be required to pay the same fee and privilege tax as are required for like vehicles owned by residents of this State. A West Virginia Certificate of Title will be issued for the vehicle, but will remain in our title files as a permanent record that the vehicle is operating with a dual registration. The foreign certificate of title will be returned to the registered owner or the lienholder, as the case may require.
6.4. West Virginia registration is not required of a resident of a foreign State who is employed or engages in a trade or occupation in West Virginia, but who does not have any established business or temporary residence in West Virginia, and who commutes daily between his residence in his home State and his work in West Virginia.
